PRIVACY STATEMENT

Your personal information is important to Interconex, Inc. (“Interconex”).

To facilitate a relocation, moving, transportation, storage or related service, Interconex may collect and use information concerning you, accompanying family or household members, the location and contents of your possessions, your contact information, documents required to provide services, information necessary to interact with governmental authorities, and employment-related information where applicable.

If your relocation is arranged through a corporation, relocation management company, moving company, freight forwarder or other service provider, some of this information may be provided to Interconex by that organization on your behalf.

Interconex is established and operates from the United States. However, Interconex provides international services involving individuals, clients, suppliers, origins and destinations throughout the world. Personal information processed by Interconex may therefore be subject to privacy and data-protection requirements in the jurisdiction where an individual resides or is located, where information is collected, where services are performed or where information is transferred.

Applicable requirements may include the EU General Data Protection Regulation (“GDPR”), the UK General Data Protection Regulation (“UK GDPR”), the Swiss Federal Act on Data Protection, the EU-U.S. Data Privacy Framework, the UK Extension to the EU-U.S. Data Privacy Framework, the Swiss-U.S. Data Privacy Framework, Canadian federal and provincial privacy laws, the California Consumer Privacy Act as amended by the California Privacy Rights Act, other U.S. state privacy laws, the Brazilian Lei Geral de Proteção de Dados, the Singapore Personal Data Protection Act, and other applicable national, regional, state, provincial or local privacy requirements.

Interconex applies privacy safeguards designed to protect personal information regardless of whether Interconex is initially aware of every citizenship, residency or jurisdictional connection associated with an individual.

Interconex does not sell personal information for monetary or other commercial consideration. Interconex does not disclose personal information for cross-context behavioral advertising and does not use relocation information for unrelated advertising purposes.

Interconex may share personal information with clients, governmental authorities, carriers, agents, service providers and other parties where necessary to arrange or perform services, comply with law, protect legitimate interests or fulfill contractual obligations.

Interconex may act as a controller, processor or subprocessor depending on the applicable contractual relationship and legal framework.

Personal information will be retained only for as long as reasonably necessary to provide services and comply with applicable contractual, legal, tax, customs, transportation, accounting, insurance, claims, regulatory and record-retention obligations. Information that is no longer required may be archived, restricted, anonymized, masked or securely deleted as legally and contractually permitted.

WHAT WE GATHER AND WHAT WE DO WITH IT

Personal information may include information that identifies, relates to, describes or can reasonably be associated with an individual or household.

Depending on the services provided, Interconex may collect:

  • Names, addresses, telephone numbers and email addresses;
  • Origin, destination and shipment information;
  • Information regarding accompanying family or household members;
  • Driver’s-license, passport, visa, work-permit and immigration information;
  • Tax identification, customs and governmental documentation;
  • Employer and employment-related relocation information;
  • Household-goods inventories and property descriptions;
  • Vehicle information;
  • Photographs or records concerning property condition;
  • Bank-account, payment, billing, insurance and claims information;
  • Communications, service instructions and customer-service records;
  • SMS and other electronic communications;
  • Information necessary to provide requested accommodations;
  • Information required for sanctions or restricted-party screening; and
  • Other information reasonably necessary to arrange, perform or document services.

Certain information processed in connection with international relocations, including government-issued identifiers, financial information, immigration documentation, information concerning children, and information necessary to provide service accommodations, may be considered sensitive or specially protected under applicable law.

Interconex processes sensitive information only where reasonably necessary, legally permitted, contractually authorized or consented to where consent is required.

LAWFUL BASIS FRAMEWORK

Where Interconex acts as a controller and applicable law requires a lawful basis, Interconex may process personal information based on:

  • The necessity of entering into or performing a contract;
  • Compliance with legal or regulatory obligations;
  • Legitimate interests relating to service delivery, business administration, security, fraud prevention, claims, legal rights and customer relationships;
  • Consent where expressly required by applicable law;
  • Protection of an individual’s vital interests in limited circumstances; or
  • Another lawful basis recognized by applicable law.

Where Interconex acts as a processor or subprocessor, personal information is processed according to the instructions of the applicable controller or contracting processor and in accordance with the governing agreement.

Personal information collected in connection with a relocation or related service is used only as reasonably necessary to arrange and perform services, communicate with the parties involved, comply with legal obligations, maintain appropriate records, protect Interconex and its customers, and fulfill the purposes disclosed at the time of collection.

SHARING OF PERSONAL INFORMATION

Interconex may share personal information with parties involved in arranging or performing services or fulfilling legal obligations, including:

  • Corporate clients and employers;
  • Relocation management companies;
  • Moving companies;
  • Freight forwarders;
  • Ocean, air, rail and motor carriers;
  • Customs brokers;
  • Origin and destination agents;
  • Storage providers;
  • Vehicle transportation providers;
  • Packing and specialty-service providers;
  • Insurance providers and claims administrators;
  • Governmental, customs, immigration, tax and regulatory authorities;
  • Financial institutions and payment providers;
  • Information-technology and communications providers;
  • Website hosting, security, consent-management and analytics providers;
  • Professional advisers; and
  • Other service providers necessary to perform contracted services.

Interconex requires service providers that process personal information on its behalf to protect that information and use it only for authorized purposes, subject to applicable legal and contractual requirements.

Interconex does not disclose personal information to marketers for their independent consumer marketing or behavioral advertising purposes.

Interconex may share limited SMS or electronic-communications information with trusted communications providers where necessary to transmit relocation-related messages and support service delivery.

Interconex may disclose personal information where it reasonably believes disclosure is necessary to:

  • Comply with applicable law, regulation, subpoena, court order or governmental request;
  • Protect the rights, property or safety of Interconex, its customers or another person;
  • Prevent, investigate or respond to fraud, security incidents or unlawful conduct;
  • Enforce an agreement;
  • Establish, exercise or defend legal claims; or
  • Respond to an emergency.

Interconex may also disclose or transfer personal information in connection with a merger, acquisition, financing, restructuring, sale of assets or similar corporate transaction, subject to appropriate confidentiality and legal safeguards.

PROCESSING ROLE CLARIFICATION

Interconex may operate in one of three legally recognized roles depending on the applicable contractual relationship:

  1. Subprocessor, where Interconex is engaged by another processor acting for a controller;
  2. Processor, where Interconex is engaged directly by a controller; or
  3. Controller, where Interconex contracts directly with an individual or independently determines the purposes and means of a particular processing activity.

When acting as a processor or subprocessor, Interconex processes personal information according to the applicable services agreement, data-processing agreement or documented instructions of the responsible controller or processor.

When acting as a controller, Interconex determines the purposes and means of processing in accordance with the applicable service relationship, legal requirements and this Privacy Statement.

DATA RETENTION

Interconex retains personal information only for as long as reasonably necessary to:

  • Provide and document contracted services;
  • Comply with tax, customs, transportation, accounting and regulatory requirements;
  • Meet insurance and claims obligations;
  • Maintain security and business records;
  • Comply with contractual retention requirements;
  • Respond to disputes, investigations or legal proceedings; and
  • Establish, exercise or defend legal claims.

Retention periods may vary based on the type of information, services provided, client instructions, applicable legal requirements and relevant statutes of limitation.

When personal information is no longer required, Interconex may securely delete, destroy, anonymize, mask, restrict or archive it in accordance with applicable law and Interconex’s retention procedures.

SUPPLIERS AND THIRD PARTIES

Interconex relies on a global network of service providers to perform international relocation and transportation services.

Interconex takes reasonable steps to require suppliers and other service providers to protect personal information, limit its use to authorized purposes, maintain appropriate security and comply with applicable legal and contractual privacy requirements.

A third party may maintain its own privacy statement where it independently determines how personal information is processed. Interconex is not responsible for a third party’s independent processing activities outside Interconex’s control, but Interconex takes reasonable steps to select and manage service providers consistent with its obligations.

TRANSFER OF INFORMATION AND LOCATION OF SERVERS

Interconex is based in the United States. Personal information may be transferred to or accessed from the United States and other countries involved in providing a relocation or related service.

Those countries may not provide privacy protections identical to those in the country where the information was originally collected.

Where required, Interconex uses appropriate safeguards for international transfers. Depending on the circumstances, these may include:

  • An adequacy decision issued by a competent authority;
  • The EU-U.S. Data Privacy Framework;
  • The UK Extension to the EU-U.S. Data Privacy Framework;
  • The Swiss-U.S. Data Privacy Framework;
  • European Commission Standard Contractual Clauses;
  • The United Kingdom International Data Transfer Agreement or UK Addendum;
  • Other approved or recognized contractual clauses;
  • Contractual necessity or another legally recognized transfer exception;
  • Explicit consent where legally permitted and appropriate; and
  • Additional contractual, technical and organizational safeguards.

DATA PRIVACY FRAMEWORK COMPLIANCE

Interconex, Inc. complies with the EU-U.S. Data Privacy Framework, the UK Extension to the EU-U.S. Data Privacy Framework and the Swiss-U.S. Data Privacy Framework as set forth by the United States Department of Commerce.

Interconex has certified to the United States Department of Commerce that it adheres to:

  • The EU-U.S. Data Privacy Framework Principles concerning personal data received from the European Union in reliance on the EU-U.S. Data Privacy Framework;
  • The UK Extension to the EU-U.S. Data Privacy Framework concerning personal data received from the United Kingdom and Gibraltar in reliance on the UK Extension; and
  • The Swiss-U.S. Data Privacy Framework Principles concerning personal data received from Switzerland in reliance on the Swiss-U.S. Data Privacy Framework.

If there is a conflict between this Privacy Statement and the applicable Data Privacy Framework Principles, the applicable Principles will govern.

Information concerning the Data Privacy Framework program and Interconex’s certification is available through the United States Department of Commerce Data Privacy Framework website.

Interconex remains responsible under the applicable Data Privacy Framework Principles for personal data transferred to third-party agents acting on its behalf if those agents process the information in a manner inconsistent with the Principles, unless Interconex proves that it was not responsible for the event giving rise to the damage.

Interconex provides individuals in the European Union, United Kingdom and Switzerland with the opportunity to opt out where personal information received in reliance on an applicable Data Privacy Framework is to be disclosed to a non-agent third party or used for a purpose materially different from the purpose for which it was originally collected or subsequently authorized.

Where sensitive information is involved, Interconex will obtain affirmative express consent where required by the applicable Data Privacy Framework Principles.

In compliance with the EU-U.S. Data Privacy Framework, the UK Extension and the Swiss-U.S. Data Privacy Framework, Interconex commits to cooperate with and comply with the advice of the panel established by the European Union data-protection authorities, the UK Information Commissioner’s Office and the Swiss Federal Data Protection and Information Commissioner, as applicable, concerning unresolved complaints involving personal data received in reliance on those frameworks.

Under certain conditions described in the Data Privacy Framework Principles, binding arbitration before the Data Privacy Framework Panel may be available after other recourse mechanisms have been exhausted.

Interconex is subject to the investigatory and enforcement powers of the United States Federal Trade Commission.

SECURITY

Interconex maintains reasonable administrative, technical, physical and organizational safeguards designed to protect personal information against unauthorized access, acquisition, disclosure, alteration, loss, misuse or destruction.

These safeguards may include:

  • Access controls based on job responsibilities;
  • Authentication and account-security measures;
  • Secure data-transmission methods;
  • Network and endpoint protections;
  • Confidentiality obligations;
  • Employee privacy and security training;
  • Service-provider security requirements;
  • Records-management controls;
  • Security monitoring;
  • Backup and recovery procedures; and
  • Documented incident-response procedures.

No transmission, processing or storage system can be guaranteed to be completely secure. Interconex maintains safeguards proportionate to the nature of the information and reasonably foreseeable risks.

DATA BREACH RESPONSE

Interconex maintains procedures for identifying, investigating, containing, remediating and documenting suspected security incidents involving personal information.

Where required by applicable law or contract, Interconex will notify the applicable client or controller, relevant governmental or supervisory authorities, and affected individuals within legally required timeframes.

CHANGES TO THIS PRIVACY STATEMENT

Interconex may update this Privacy Statement to reflect changes in its services, processing activities, technology, vendors, legal obligations, regulatory guidance or security practices.

Interconex reviews this Privacy Statement at least annually and additionally when a material change occurs.

The Revised Date shown above identifies the current version.

Where required by applicable law, Interconex will provide additional notice or obtain renewed consent before materially changing a consent-based processing purpose.

YOUR PRIVACY RIGHTS

Depending on applicable law and Interconex’s processing role, an individual may have the right to:

  • Request confirmation that personal information is being processed;
  • Access personal information;
  • Correct inaccurate personal information;
  • Request deletion of personal information;
  • Restrict or object to certain processing;
  • Withdraw consent where processing is based on consent;
  • Receive certain personal information in a portable format;
  • Opt out of direct marketing;
  • Opt out of sale, sharing, targeted advertising or qualifying profiling where applicable;
  • Limit certain uses of sensitive personal information where applicable;
  • Use an authorized representative where permitted;
  • Appeal the denial of a request where applicable;
  • Receive equal service and not be unlawfully discriminated against for exercising privacy rights; and
  • Lodge a complaint with an applicable privacy or data-protection authority.

Interconex does not sell personal information or use personal information for cross-context behavioral advertising.

Where Interconex processes personal information on behalf of an employer, relocation management company or another controller, an individual should ordinarily direct the request to that controller.

If Interconex receives the request directly, Interconex may forward it to the responsible controller, assist the controller in responding, or respond directly where legally required or contractually authorized.

Interconex uses limited automatic data-collection technologies on its public website.

Depending on the visitor’s privacy choices, these technologies may collect:

Interconex requires website service providers processing information on its behalf to protect the information and use it only for authorized business purposes, subject to applicable contractual and legal requirements.

Interconex does not intentionally deploy business visitor-identification technology within authenticated customer portals or systems used to submit passports, immigration documents, financial information, household-goods records or other sensitive relocation information.

Interconex may collect information voluntarily submitted through:

  • Rate-request forms;
  • Contact forms;
  • Service inquiries;

Information submitted through a website form may be used to respond to the request, evaluate or provide services, communicate with the requester, maintain appropriate business records and fulfill other purposes disclosed when the information is collected.
